As a form of alternative dispute resolution, mediation has increased in popularity and is becoming one of the court’s preferred methods of resolving a range of family law cases. Our law firm encourages mediation when appropriate and is uniquely equipped to resolve such cases.
Divorce litigation can be a long and very expensive process. In comparison, mediation can be a cost-effective and timesaving alternative when resolving disputes. Mediation does not require that the parties meet before a judge. Due to the overload of court dockets, the mere scheduling of court dates is a significant delay and a barrier to resolving divorce issues. A mediator, on the other hand, is not restrained by the court’s schedule and can expedite a resolution.
The mediator’s role is to facilitate a compromise between two parties. A skillful mediator can help the parties set aside negative feelings that interfere with rational decision-making so that the parties can find common ground upon which to build an agreement. Neither party forfeits the right to go to court if mutually agreeable terms cannot be resolved using this method.
