Florida doesn’t have a domestic partnership law that extends to same-sex couples the same rights and obligations that married couples have. However, many same-sex couples own property and care for children together. It is a good idea to get a lawyer’s help in drafting a partnership agreement that spells out each party’s rights and obligations when it comes to:
How property will be divided upon dissolution of the partnership
Whether one party is entitled to support payments and for how long
If there are children, how custody, visitation, and child support will be shared
Even though the legal status of same-sex couples may change based on new public policy, same-sex couples still face the same issues that married couples face. In the event of a partnership dissolution the distribution of assets and liabilities could be expensive and litigious to resolve if there is no legal agreement. Individuals registered as a domestic partner in another state, should consult an attorney to see which state laws apply.
